Select Jurisdictional Trust Regulation

There are many factors to consider when deciding on where to locate a trust and which State’s laws will govern the trust.  A handful of these factors continue to garner much attention, and be on the forefront of States’ efforts at both refining laws around trusts and promoting their State as the place to be for trusts and trustees.  In this article, we set forth some of these factors, and a sampling of how some States operate within each area of this regulation affecting private trusts.
