The new Corporate Transparency Act (“CTA”), which took effect January 1, 2024, has been held unconstitutional by the U.S. District Court in Alabama. The District Court Judge held there was lack of case precedent for the argument that national security supports such Congressional regulation, and the U.S. Department of Justice has appealed this ruling. The CTA’s enforcement has been halted pending the appeal, and we will continue to provide updates for our Members.
